History of software patent law
The US has granted patents that may be referred to as software patent law as early as the 1970s. Within the European Union software patent law is governed by EPO or the European Patent convention Office and has issued many patents for inventions involving software. In Japan, software patent law allows software-related inventions and is patentable and to qualify for it there must be a creation of technical ideas utilizing a law of nature although this requirement is typically met by concretely realizing the information processing performed by the software by using hardware resources. In India, a clause to include software patents was quashed by the Indian Parliament in 2005.
